GENERAL ELECTION SUPERVISION IN THE DELIBERATIVE DEMOCRACY PERSPECTIVE (A JURIDICAL ANALYSIS OF THE APPLICATION OF THE DELIBERATIVE DEMOCRACY THEORY IN THE ELECTORAL SUPERVISION SYSTEM IN INDONESIA)
Abstract
The holding of fair and just general elections is a constitutional mandate. The oversight system in the general election becomes a very important part in realizing a fair and just general election for all parties. The system of electoral supervision in Indonesia is governed by several provisions of the law. The theory of deliberative democracy is more interesting to be applied in various government policies because it is considered capable of realizing the real democratic goals.
This study aims to analyze related to the election supervision system in the perspective of deliberative democracy. Is the election supervisory system in Indonesia already accommodating the principle of deliberative democracy? The method used in this study is normative juridical by analyzing the provisions in legislation related to election supervision. The results of the study were analyzed using the theory of deliberative democracy.
The results of this study found that the electoral supervision system in Indonesia has provided a concept of participatory oversight. The concept of participatory oversight provides space for the community to participate in electoral supervision. So it can be concluded that the system of supervision of general elections in Indonesia has applied deliberative democracy. The recommendation is given that the Election Supervisory Board can socialize to the whole community related to the concept of participatory oversight.
